Welcome to Kama Visuals. By accessing our website, booking our services, or purchasing any products, you agree to the following Terms & Conditions. Please read them carefully.

1. Services Provided

Kama Visuals provides professional photography services, photo booth rentals, digital image galleries, and related creative services for individuals, families, events, organizations, and commercial clients.

 

Specific services, deliverables, pricing, and timelines will be outlined in your booking agreement, invoice, or package description.

2. Booking & Payments

  • A booking is not confirmed until payment (deposit or full amount, depending on the service) is received.

  • All prices are listed in USD unless otherwise stated.

  • Remaining balances must be paid in full before final galleries, downloads, or deliverables are released, unless otherwise agreed in writing.

  • Late payments may delay delivery of images or galleries.

3. Cancellations & Rescheduling

  • Cancellations must be made in writing.

  • Deposits are non-refundable.

  • Rescheduling is subject to availability and must be requested at least [X] days prior to the scheduled service.

  • Kama Visuals reserves the right to cancel or reschedule due to unforeseen circumstances (weather, illness, emergencies, equipment failure). In such cases, a reschedule or refund (excluding non-recoverable costs) will be offered.

4. Image Delivery & Turnaround

  • Editing and delivery timelines vary by service and will be communicated at the time of booking.

  • Galleries are delivered digitally via an online platform.

  • Unedited or RAW images are not provided.

  • Kama Visuals retains full artistic discretion over editing style, image selection, and final presentation.

5. Image Selection & Releases

  • Preview galleries may contain watermarked or limited-resolution images.

  • Full-resolution images and complete galleries will only be released after full payment is received.

  • Kama Visuals is not responsible for missed shots due to client behavior, venue restrictions, lighting conditions, or circumstances beyond our control.

6. Copyright & Usage Rights

  • All photographs and media produced by Kama Visuals are protected under U.S. copyright law.

  • Kama Visuals retains full copyright ownership of all images.

  • Clients are granted a personal use license unless otherwise stated.

  • Commercial use, resale, or alteration of images requires written permission.

  • Kama Visuals reserves the right to use images for portfolio, website, social media, advertising, and promotional purposes unless the client submits a written opt-out request prior to the session.

7. Photo Booth Rentals

  • The client is responsible for ensuring safe use of photo booth equipment.

  • Damage caused by misuse, negligence, or guest behavior may result in repair or replacement fees.

  • Kama Visuals is not liable for injuries, accidents, or technical interruptions beyond reasonable control.

8. Client Responsibilities

  • Clients are responsible for arriving on time and ensuring cooperation of participants.

  • Delays caused by the client may reduce coverage time.

  • Required permits, venue permissions, or location approvals must be secured by the client unless otherwise agreed.

9. Website Use

  • Content on this website is for informational purposes only.

  • You may not copy, reproduce, or distribute any content without written permission.

  • Kama Visuals is not responsible for technical issues, downtime, or third-party service interruptions.

10. Limitation of Liability

  • Kama Visuals’ liability is limited to the amount paid for services.

  • We are not responsible for indirect, incidental, or consequential damages.

  • In the unlikely event of total image loss due to equipment failure or unforeseen circumstances, liability is limited to a refund of payments received.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy. We do not sell or share your information without consent, except as required by law.

12. Governing Law

These Terms & Conditions are governed by the laws of the State of Hawaii.

13. Changes to Terms

Kama Visuals reserves the right to update these Terms & Conditions at any time. Continued use of our website or services constitutes acceptance of any changes.
